A <a href="http://www.custodyguidelines.com/" title="child custody mother's right ">mother&#8217;s child custody battle</a>, most often is a very stressful situation. To make things worse, many women don&#8217;t play as active a role as they should throughout the court process and tend to overly rely on their attorneys.</p>
<p> This can potentially put a mother&#8217;s child custody case in jeopardy, due to the fact that the ex spouse as well as the attorneys on both side will take advantage of this.</p>
<p> In this article, I want to provide some guidance to help you get through this as best as possible. There are many things to look out for and keep in mind, you don&#8217;t want to make any mistakes that can potentially be used against you.</p>
<p> 1. Do not show any hostility towards other women : It doesn&#8217;t matter if it is the one your ex husband had an affair with, the current girlfriend, or new wife. I know this is hard, but do your best at least until your child custody battle is over with. It can be used as ammunition against your case.</p>
<p> 2. Don&#8217;t call the police on your ex : Unless you or your children are in danger of being physically harmed, this will only make things turn out ugly for everyone.</p>
<p> 3. If you are unemployed you need to get a job : You need to show to the judge that you are capable of supporting your children financially and not simply counting on living off of child support of spousal maintenance. </p>

			<content:encoded><![CDATA[<h1>Child Custody - Joint Custody and the Best Interest of the Child Standard</h1>

<p>  &quot;In the best interest of the child&quot; or &quot;child&#8217;s best interest&quot; is the famous mantra of the family court, which is prevalent in child custody proceedings today, yet its interpretation by the family court or judges is often arbitrary and its meaning is still obscure.  Moreover, the law regarding&nbsp;&nbsp; varies from state to state leaving no uniform legal position regarding what is in the best interest of the child.  Some states have a preference and presumption towards joint custody while others do not.  Some states are amending its law to adopt a preference and presumption for joint custody while others are amending its law to allow joint custody only when the parents agree to it.</p>
<p> Like most states the standard for <a href="http://www.custodyguidelines.com/" title="how to win a custody battle ">child custody</a> determination in California is the overall best interest of the child such that it assures the &quot;health, safety, and welfare&quot; of the child and &quot;frequent and continuing contact&quot; with both parents.   However, California does not establish a preference or a presumption for or against joint custody or custody to one parent and therefore leaves the parenting plan decision up to the discretion of the family court or a judge.  In 1979, California adopted a presumption for joint custody, but later amended the law in 1994 to allow joint custody only when the parents agreed to it.  According to the <a href="http://www.abanet.org/media/factbooks/cht4.html">American Bar Association</a>, other states such as Connecticut, Maine, Michigan, Mississippi, Nevada, Vermont, and Washington also adopted laws in favor of joint custody, but only when the parents agreed to it.  Other states such as the District of Columbia, Florida, Idaho, Iowa, Kansas, Louisiana, Minnesota,  Missouri, Montana, New Hampshire, New Mexico, and Texas, have laws favoring a presumption for joint custody.  In a few other states, joint custody is not specifically authorized.</p>
<p> <img src="http://www.dallasattorneyfamilylaw.com/images/Dallas_Attorney_Child_Custody.jpg" alt="child custody grandparents rights " hspace="10" vspace="10" width="160" height="112" align="left" />Regardless of each states position for or against a presumption or preference in favor of <a href="http://www.custodyguidelines.com/child-support-tips-choosing-an-attorney" title="guidelines for joint custody ">joint custody</a> and whether or not it has been specifically authorized, overall there appears to be a growing trend in favor of joint custody and more and more bills being introduced to adopt a presumption for joint custody being in the best interest of the child unless certain circumstances apply, such as convincing evidence that a parent is unfit or it would not be in the best interest of the child to award joint custody.</p>
<p> If you are involved in a child custody dispute, whether it is the initial child custody determination or a child custody modification, you would be wise to consult a family law attorney in your jurisdiction to help you learn what the law and standard for custody determinations is in your area and how it applies to your specific situation.  Further you will want to learn what factors the court will consider in determining the best interest of the child so you are fully aware of your child custody rights and responsibilities.</p>

<p>If you&#8217;d like to receive child support from the other parent, or you&#8217;d like to receive more child support from the other parent, you should consult with a good family law attorney at your earliest convenience.<br /> A good attorney doesn&#8217;t cost you money, she either makes you money or she saves you money.<br /> The problem I see far too often involves people who think they are entitled to more child support just because. Just because they&#8217;re not making enough to pay the bills. Just because their friend is getting more child support than they are. Just because their friends say so. Just because. &#8216;Just because&#8217; may be a terrific emotional reason, but it&#8217;s not a legal justification for child support.</p>

<p> A good family law attorney will advise you as to the amount of child support you&#8217;re entitled to, and whether it would be wise to go to court or make do with what you&#8217;re receiving.</p>
<p> You may have noticed I insert &#8216;good&#8217; before family law attorney. That&#8217;s because a lousy family law attorney, or a great attorney who knows little about family law, can actually cost you money.</p>
<p> <img src="http://thumbs.dreamstime.com/thumbimg_310/12213774681li8jv.jpg" border="0" alt="court ordered child support" hspace="8" vspace="0" align="right" /> STORY: A number of years ago I was sitting in Department 20 of the Solano County Superior Court in Vallejo, waiting for my case to be called. I was listening to a matter which involved a mother who had, with the help of an non-family law attorney, filed a motion asking for more child support. It had been a number of years since the original child support order and the mother assumed that with the passage of time, she was certainly entitled to more child support.</p>
<p> This mother assumed that since she had received significant pay increases since the prior order that the father had as well&#8230; he hadn&#8217;t.</p>
<p> In addition, both the mother and her attorney failed to take into consideration the fact that the child, now a teenager, was spending a lot more time with the father than he had been doing at the time of the prior order.</p>
<p> When Commissioner Haet calculated the support, the mother (and her attorney) were shocked to learn that not only was the mother not going to more child support, but her child support payment was actually going to decrease by several hundred dollars.</p>
<p> The commissioner asked the attorney if he had calculated the child support prior to the hearing. He had not. Had the attorney done so, he probably would have tried his best to advise his client to drop her motion.</p>
<p> Despite the fact that his client lost she asked the court to order the father, who was representing himself, to pay her attorney fees. The court declined to do so.</p>
<p> The court hearing was an all-around disaster for this mother, due to the fact that she did not retain a &#8216;good&#8217; family law attorney. Good family law attorneys do not assume anything, but instead base their opinion on facts.<br /> You may not like what a good family law attorney has to tell you, but I guarantee it will be better that you hear it from a good family law in the privacy of their office, as opposed to hearing it from a judge in front of a courtroom full of people, including the other parent.</p>
